General Terms and Conditions of Sale
Purpose and Scope of Application
- All product sales made at Dois Marias, between the client, as the buyer, and Dois Marias as the seller, are regulated by the General Terms and Conditions of Sale. Such conditions apply to visitors as well as to any commercial transaction carried out through our Online Store;
- Product search, as well as its acquisition, is subject to the acceptance of the General Terms of Use, defined by Dois Marias;
- Dois Marias will consider "Client," "User," or "Buyer" any individual who purchases products or services from the Online Store;
- Given the growing evolution of Online shopping platforms, Dois Marias may, at any time and without prior notice, alter the aforementioned Conditions of Use. Under the same conditions, information and commercial offers regarding products, prices, commercial conditions, and promotions may be modified;
- All orders placed by users who do not comply with Dois Marias' General Terms of Sale may not be considered, and Dois Marias reserves the right not to process them;
- A valid email address or telephone contact must always be provided by the "Client," allowing Dois Marias to contact the "Client" whenever appropriate. This contact is previously accepted and authorised by the consumer.
Commercial Policy
- The client will always have the right to terminate the Purchase and Sale contract, under the applicable legal terms, if the product or service information presented in the Online Store does not correspond to their characteristics;
- Any alteration to the price and characteristics of the product does not require prior notice;
- The consumer must be aware of and have accepted Dois Marias' General Terms and Conditions of Sale before validating their purchase order;
- All data registered by Dois Marias serves as proof of the set of transactions carried out between Dois Marias and the "Client."
- All products present at Dois Marias are its property until payment is made by the consumer for their acquisition.
Prices
- All values presented at Dois Marias are already subject to Value Added Tax (VAT);
- At the end of the online purchase process, the client will be presented with a final value that includes the value of the products, Value Added Tax, and delivery costs, if applicable. The invoice for the purchase will be delivered with the order;
- The prices of the products presented at Dois Marias are itemised in Euros, and the only alteration to the final value will only be verified taking into account transport costs or the allocation of a promotional discount, if applicable.
Liability
- Dois Marias will only be liable for damages suffered by the "Buyer" if such damages result from attributable breaches of Dois Marias' contractual obligations towards the "Consumer," or if the liability results from applicable legal rights;
- Any damage suffered by the consumer as a result of inappropriate use of the products will not be the responsibility of Dois Marias;
- Dois Marias assumes no responsibility in case of violation of the legislation of the country where the order is delivered. The client must verify with local authorities the conditions for importing or using the products they intend to order.
Intellectual and Industrial Property
- All texts, comments, works, and images reproduced or represented at Dois Marias are strictly reserved under copyright law as well as intellectual property rights, for the entire world;
- Accordingly, and under the Intellectual Property Code, the use of information for private purposes is only authorised, subject to contrary provisions, including more restrictive provisions contained in the said code;
- Any reproduction or representation, total or partial, of Dois Marias or the elements included therein is strictly prohibited;
- The company names, brands, and distinctive signs reproduced at Dois Marias are protected under the legal provisions applicable to industrial property. The reproduction or representation of all or part of any distinctive signs is strictly prohibited and must be subject to prior written authorisation from the owner of the Dois Marias brand;
- If the "User" intends to use information or materials from the Online Store, they must obtain prior written authorisation granted by Dois Marias.
Applicable Law
- These Terms and Conditions and all emerging disputes related to these general conditions, including their validity, the use of the online store www.doismarias.pt or any purchase therein, shall be governed by Portuguese Law;
- In case of dispute regarding the interpretation or execution of these Terms and Conditions, Dois Marias and the "Buyer" undertake to seek an amicable, fair, and appropriate solution, within a maximum period of 60 (sixty) days from the receipt of communication sent for this purpose by either party involved;
- In the absence of an amicable solution, as provided in the preceding paragraph, and in case of non-compliance with these Terms and Conditions, both parties agree to the jurisdiction of the Court of Elvas, expressly waiving any other.
